Article 2017 of the French Civil Code

Unless otherwise stipulated in the trust agreement, the settlor may at any time appoint a third party to ensure that his interests are safeguarded in the performance of the agreement and who may have the powers granted by law to the settlor.

Where the settlor is a natural person, he may not waive this option.

The settlor must inform the trustee of the appointment of this third party.

Sauf stipulation contraire du contrat de fiducie, le constituant peut, à tout moment, désigner un tiers chargé de s’assurer de la préservation de ses intérêts dans le cadre de l’exécution du contrat et qui peut disposer des pouvoirs que la loi accorde au constituant.

Lorsque le constituant est une personne physique, il ne peut renoncer à cette faculté.

Le constituant doit informer le fiduciaire de la désignation de ce tiers.
