For cinematographic works in the fiction genre, points are divided into five groups as follows:
I.-Language of Filming” group
1° A maximum of 20 points is allocated to the “Language of Filming” group;
2° Points are awarded as follows:
a) 20 points when the film is produced entirely in the original version in French or in a regional language used in France or, if at least two different languages are used, when French or a regional language used in France is the language used most often;
b) 10 points when a foreign language is the language used most often for artistic reasons relating to the script, but French or a regional language used in France is used for at least one third of the dialogue and, where applicable, the voice-over;
c) 20 points when the film is based on an opera and produced in the language of the libretto.
II.Production company and authors” group
The “Production company and authors” group is awarded a maximum of 20 points divided between the following two sub-groups:
1° “Production company” sub-group :
a) A maximum of 9 points is allocated to the “Production company” sub-group;
b) Points are awarded if the cinematographic work is produced by at least one production company that meets the conditions set out in article 211-3;
2° “Authors” sub-group:
a) A maximum of 11 points is allocated to the “Authors” sub-group, divided between the following positions:
-director: 5 points;
-author of the original work, screenplay, adaptation and spoken text: 5 points;
-author of the musical compositions with or without words specially created for the work: 1 point;
b) Points are awarded if the following conditions are met:
-the director and the other authors are French nationals or equivalent.
By way of derogation and following the opinion of the approval commission, for French-initiated cinematographic works, foreigners other than those assimilated to French nationals are taken into account for the allocation of points if the production company that meets the conditions set out in article 211-3 is the initiator of the cinematographic work:
-with regard to the director, the audiovisual production contract and the employment contract designate French law as the applicable law;
-with regard to the other authors, the audiovisual production contract designates French law as the applicable law;
c) Any point relating to an item or one of its elements that is not used for justified artistic or technical reasons is deemed to have been obtained for French-initiative cinematographic works.
III – “Performers” group
1° A maximum of 20 points is allocated to the “Performers” group;
2° The number of points obtained is determined according to the ratio between:
-on the one hand, the number of fees received by performers in roles giving rise to at least three fees, taken into account under the conditions set out in 3°;
– on the other hand, the total number of fees received by all performers in roles giving rise to at least three fees;
3° Performers are taken into account if the following conditions are met:
a) The performers are French nationals or assimilated;
b) The contract concluded with the performers designates French law as the applicable law;
4° The points are deemed to have been obtained in full when, for justified artistic or technical reasons, either no performers are used or only performers providing roles giving rise to less than three fees are used, for French-initiated cinematographic works.
IV – “Technicians and workers” group
A maximum of 20 points are allocated to the “Technicians and workers” group, divided between the following two sub-groups:
1° “Techniciens cadres collaborateurs de création” sub-group:
a) A maximum of 10 points are allocated to the “Techniciens cadres collaborateurs de création” sub-group, divided between the following positions:
production director: 1.25 points;
– director of photography: 1.25 points;
– head sound operator: 1 point;
– costume designer or, failing that, head costume designer: 1 point;
-head set designer or, failing that, head set designer: 1.25 points;
-head picture editor: 1.25 points;
-head sound editor: 1 point;
-mixer: 1 point;
-bruiser: 1 point;
b) Points are awarded if the following conditions are met:
the executive creative collaborators are French nationals or equivalent;
– the contract concluded with the executive creative collaborators designates French law as the applicable law;
c) Any points relating to a position that is not used for justified artistic or technical reasons are deemed to have been obtained for French-initiative cinematographic works;
2° Sub-group “Workers, management and non-management technicians”:
a) A maximum number of 10 points is allocated to the sub-group “Workers, management and non-management technicians”;
b) The number of points obtained is determined according to the ratio between:
on the one hand, the amount of remuneration, including social security contributions, of manual workers and technicians in managerial and non-managerial positions, taken into account under the conditions set out in c;
– on the other hand, the total amount of remuneration, including social security contributions, of all manual workers and technicians in managerial and non-managerial positions;
c) Managers and non-managerial workers and technicians are taken into account if the following conditions are met:
the workers and technicians in managerial and non-managerial positions are French nationals or equivalent;
-the contract concluded with the workers and technicians in managerial and non-managerial positions designates French law as the applicable law;
d) Points are deemed to have been obtained in full when, for justified artistic or technical reasons, no workers or technicians (managerial or non-managerial) are used for French-initiated cinematographic works.
V.-“Shooting and post-production” group
A.-A maximum of 20 points is allocated to the “Shooting and post-production” group, divided between the following three sub-groups:
1° “Shooting locations” sub-group:
a) 5 points are allocated to the “Shooting locations” sub-group;
b) Points are obtained if the shooting takes place in France. If part of the filming takes place abroad and is not justified by artistic reasons relating to the script, the points will not be awarded;
2° “Technical equipment for filming” sub-group:
a) A maximum of 4.5 points will be awarded for the “Technical equipment for filming” sub-group, divided between the following items:
shooting: 2 points;
-lighting: 1.5 points;
-machinery and other equipment: 1 point;
b) Points will be awarded if at least 50% of the expenditure relating to each item concerned is incurred by companies established in France;
3° “Post-production” sub-group:
a) A maximum of 10.5 points will be awarded to the “Post-production” sub-group, divided between the following items:
-image: 3.5 points. These points apply to all image post-production work, with the exception of digital visual effects;
-sound: 3.5 points. These points apply to all sound post-production work;
-digital visual effects: 3.5 points. When this position is not used for justified artistic or technical reasons, points are awarded if the points corresponding to the “Image” and “Sound” positions are obtained;
b) Points are obtained if at least 50% of the expenditure relating to each item concerned corresponds to services provided by companies established in France.
B.-Any point relating to an item other than “Digital Visual Effects” which is not used for justified artistic or technical reasons is deemed to have been obtained for French-initiated cinematographic works.
