Article 211-10 of the French Cinema and Moving Image Code

For cinematographic works in the fiction genre, points are divided into five groups as follows:
I.-Language of Filming” group
1° A maximum of 20 points is allocated to the “Language of Filming” group;
2° Points are awarded as follows:
a) 20 points when the film is produced entirely in the original version in French or in a regional language used in France or, if at least two different languages are used, when French or a regional language used in France is the language used most often;
b) 10 points when a foreign language is the language used most often for artistic reasons relating to the script, but French or a regional language used in France is used for at least one third of the dialogue and, where applicable, the voice-over;
c) 20 points when the film is based on an opera and produced in the language of the libretto.
II.Production company and authors” group
The “Production company and authors” group is awarded a maximum of 20 points divided between the following two sub-groups:
1° “Production company” sub-group :
a) A maximum of 9 points is allocated to the “Production company” sub-group;
b) Points are awarded if the cinematographic work is produced by at least one production company that meets the conditions set out in article 211-3;
2° “Authors” sub-group:
a) A maximum of 11 points is allocated to the “Authors” sub-group, divided between the following positions:

-director: 5 points;
-author of the original work, screenplay, adaptation and spoken text: 5 points;
-author of the musical compositions with or without words specially created for the work: 1 point;

b) Points are awarded if the following conditions are met:

-the director and the other authors are French nationals or equivalent.

By way of derogation and following the opinion of the approval commission, for French-initiated cinematographic works, foreigners other than those assimilated to French nationals are taken into account for the allocation of points if the production company that meets the conditions set out in article 211-3 is the initiator of the cinematographic work:

-with regard to the director, the audiovisual production contract and the employment contract designate French law as the applicable law;
-with regard to the other authors, the audiovisual production contract designates French law as the applicable law;

c) Any point relating to an item or one of its elements that is not used for justified artistic or technical reasons is deemed to have been obtained for French-initiative cinematographic works.
III – “Performers” group
1° A maximum of 20 points is allocated to the “Performers” group;
2° The number of points obtained is determined according to the ratio between:

-on the one hand, the number of fees received by performers in roles giving rise to at least three fees, taken into account under the conditions set out in 3°;
– on the other hand, the total number of fees received by all performers in roles giving rise to at least three fees;

3° Performers are taken into account if the following conditions are met:
a) The performers are French nationals or assimilated;
b) The contract concluded with the performers designates French law as the applicable law;
4° The points are deemed to have been obtained in full when, for justified artistic or technical reasons, either no performers are used or only performers providing roles giving rise to less than three fees are used, for French-initiated cinematographic works.
IV – “Technicians and workers” group
A maximum of 20 points are allocated to the “Technicians and workers” group, divided between the following two sub-groups:
1° “Techniciens cadres collaborateurs de création” sub-group:
a) A maximum of 10 points are allocated to the “Techniciens cadres collaborateurs de création” sub-group, divided between the following positions:

production director: 1.25 points;
– director of photography: 1.25 points;
– head sound operator: 1 point;
– costume designer or, failing that, head costume designer: 1 point;
-head set designer or, failing that, head set designer: 1.25 points;
-head picture editor: 1.25 points;
-head sound editor: 1 point;
-mixer: 1 point;
-bruiser: 1 point;

b) Points are awarded if the following conditions are met:

the executive creative collaborators are French nationals or equivalent;
– the contract concluded with the executive creative collaborators designates French law as the applicable law;

c) Any points relating to a position that is not used for justified artistic or technical reasons are deemed to have been obtained for French-initiative cinematographic works;
2° Sub-group “Workers, management and non-management technicians”:
a) A maximum number of 10 points is allocated to the sub-group “Workers, management and non-management technicians”;
b) The number of points obtained is determined according to the ratio between:

on the one hand, the amount of remuneration, including social security contributions, of manual workers and technicians in managerial and non-managerial positions, taken into account under the conditions set out in c;
– on the other hand, the total amount of remuneration, including social security contributions, of all manual workers and technicians in managerial and non-managerial positions;

c) Managers and non-managerial workers and technicians are taken into account if the following conditions are met:

the workers and technicians in managerial and non-managerial positions are French nationals or equivalent;
-the contract concluded with the workers and technicians in managerial and non-managerial positions designates French law as the applicable law;

d) Points are deemed to have been obtained in full when, for justified artistic or technical reasons, no workers or technicians (managerial or non-managerial) are used for French-initiated cinematographic works.
V.-“Shooting and post-production” group
A.-A maximum of 20 points is allocated to the “Shooting and post-production” group, divided between the following three sub-groups:
1° “Shooting locations” sub-group:
a) 5 points are allocated to the “Shooting locations” sub-group;
b) Points are obtained if the shooting takes place in France. If part of the filming takes place abroad and is not justified by artistic reasons relating to the script, the points will not be awarded;
2° “Technical equipment for filming” sub-group:
a) A maximum of 4.5 points will be awarded for the “Technical equipment for filming” sub-group, divided between the following items:

shooting: 2 points;
-lighting: 1.5 points;
-machinery and other equipment: 1 point;

b) Points will be awarded if at least 50% of the expenditure relating to each item concerned is incurred by companies established in France;
3° “Post-production” sub-group:
a) A maximum of 10.5 points will be awarded to the “Post-production” sub-group, divided between the following items:

-image: 3.5 points. These points apply to all image post-production work, with the exception of digital visual effects;
-sound: 3.5 points. These points apply to all sound post-production work;
-digital visual effects: 3.5 points. When this position is not used for justified artistic or technical reasons, points are awarded if the points corresponding to the “Image” and “Sound” positions are obtained;

b) Points are obtained if at least 50% of the expenditure relating to each item concerned corresponds to services provided by companies established in France.
B.-Any point relating to an item other than “Digital Visual Effects” which is not used for justified artistic or technical reasons is deemed to have been obtained for French-initiated cinematographic works.

Article 211-10

Pour les œuvres cinématographiques appartenant au genre fiction, les points sont répartis entre cinq groupes, dans les conditions suivantes :
I.-Groupe ” Langue de tournage ”
1° Il est affecté au groupe ” Langue de tournage ” un nombre maximal de 20 points ;
2° Les points sont obtenus dans les conditions suivantes :
a) 20 points lorsque l’œuvre cinématographique est réalisée intégralement en version originale en langue française ou dans une langue régionale en usage en France ou, si au moins deux langues différentes sont employées, lorsque la langue française ou une langue régionale en usage en France est la langue la plus utilisée ;
b) 10 points lorsqu’une langue étrangère est la langue la plus utilisée pour des raisons artistiques tenant au scénario mais que la langue française ou une langue régionale en usage en France est employée pour au moins un tiers de la durée des dialogues et, le cas échéant, de la voix off ;
c) 20 points lorsque l’œuvre cinématographique est tirée d’un opéra et réalisée dans la langue du livret.
II.-Groupe ” Entreprise de production et auteurs ”
Il est affecté au groupe ” Entreprise de production et auteurs ” un nombre maximal de 20 points repartis entre les deux sous-groupes suivants :
1° Sous-groupe ” Entreprise de production ” :
a) Il est affecté au sous-groupe ” Entreprise de production ” un nombre de 9 points ;
b) Les points sont obtenus si l’œuvre cinématographique est produite par au moins une entreprise de production qui satisfait aux conditions prévues à l’article 211-3 ;
2° Sous-groupe ” Auteurs ” :
a) Il est affecté au sous-groupe ” Auteurs ” un nombre maximal de 11 points répartis entre les postes suivants :

-réalisateur : 5 points ;
-auteurs de l’œuvre originaire, du scénario, de l’adaptation et du texte parlé : 5 points ;
-auteur des compositions musicales avec ou sans paroles spécialement réalisées pour l’œuvre : 1 point ;

b) Les points sont obtenus si les conditions suivantes sont remplies :

-le réalisateur et les autres auteurs sont ressortissants français ou assimilés.

Par dérogation et après avis de la commission d’agrément, pour les œuvres cinématographiques d’initiative française, les étrangers autres que ceux assimilés aux ressortissants français sont pris en compte pour l’attribution des points dès lors que l’entreprise de production qui satisfait aux conditions prévues à l’article 211-3 est à l’initiative de l’œuvre cinématographique :

-en ce qui concerne le réalisateur, le contrat de production audiovisuelle et le contrat de travail désignent la loi française comme loi applicable ;
-en ce qui concerne les autres auteurs, le contrat de production audiovisuelle désigne la loi française comme loi applicable ;

c) Tout point relevant d’un poste ou de l’un de ses éléments auquel il n’est pas fait appel pour des raisons artistiques ou techniques justifiées est réputé obtenu pour les œuvres cinématographiques d’initiative française.
III.-Groupe ” Artistes-interprètes ”
1° Il est affecté au groupe ” Artistes-interprètes ” un nombre maximal de 20 points ;
2° Le nombre de points obtenu est déterminé en fonction du rapport entre :

-d’une part, le nombre de cachets perçus par les artistes-interprètes assurant des rôles donnant lieu à au moins trois cachets, pris en compte dans les conditions prévues au 3° ;
-d’autre part, le nombre total de cachets perçus par l’ensemble des artistes-interprètes assurant des rôles donnant lieu à au moins trois cachets ;

3° Les artistes-interprètes sont pris en compte si les conditions suivantes sont remplies :
a) Les artistes-interprètes sont ressortissants français ou assimilés ;
b) Le contrat conclu avec les artistes-interprètes désigne la loi française comme loi applicable ;
4° Les points sont réputés obtenus en totalité lorsque, pour des raisons artistiques ou techniques justifiées, soit il n’est fait appel à aucun artiste-interprète soit il est uniquement fait appel à des artistes-interprètes assurant des rôles donnant lieu à moins de trois cachets, pour les œuvres cinématographiques d’initiative française.
IV.-Groupe ” Techniciens et ouvriers ”
Il est affecté au groupe ” Techniciens et ouvriers ” un nombre maximal de 20 points répartis entre les deux sous-groupes suivants :
1° Sous-groupe ” Techniciens cadres collaborateurs de création ” :
a) Il est affecté au sous-groupe ” Techniciens cadres collaborateurs de création ” un nombre maximal de 10 points répartis entre les postes suivants :

-directeur de production : 1,25 point ;
-directeur de la photographie : 1,25 point ;
-chef opérateur du son : 1 point ;
-créateur de costumes ou à défaut chef costumier : 1 point ;
-chef décorateur ou à défaut ensemblier décorateur : 1,25 point ;
-chef monteur image : 1,25 point ;
-chef monteur son : 1 point ;
-mixeur : 1 point ;
-bruiteur : 1 point ;

b) Les points sont obtenus si les conditions suivantes sont remplies :

-les techniciens cadres collaborateurs de création sont ressortissants français ou assimilés ;
-le contrat conclu avec les techniciens cadres collaborateurs de création désigne la loi française comme loi applicable ;

c) Tout point relevant d’un poste auquel il n’est pas fait appel pour des raisons artistiques ou techniques justifiées est réputé obtenu pour les œuvres cinématographiques d’initiative française ;
2° Sous-groupe ” Ouvriers, techniciens cadres et non cadres ” :
a) Il est affecté au sous-groupe ” Ouvriers, techniciens cadres et non cadres ” un nombre maximal de 10 points ;
b) Le nombre de points obtenu est déterminé en fonction du rapport entre :

-d’une part, le montant des rémunérations, charges sociales comprises, des ouvriers et des techniciens cadres et non cadres, pris en compte dans les conditions prévues au c ;
-d’autre part, le montant total des rémunérations, charges sociales comprises, de l’ensemble des ouvriers et des techniciens cadres et non cadres ;

c) Les ouvriers et les techniciens cadres et non cadres sont pris en compte si les conditions suivantes sont remplies :

-les ouvriers et les techniciens cadres et non cadres sont ressortissants français ou assimilés ;
-le contrat conclu avec les ouvriers et les techniciens cadres et non cadres désigne la loi française comme loi applicable ;

d) Les points sont réputés obtenus en totalité lorsque, pour des raisons artistiques ou techniques justifiées, il n’est fait appel à aucun ouvrier ni à aucun technicien cadre et non cadre, pour les œuvres cinématographiques d’initiative française.
V.-Groupe ” Tournage et post-production ”
A.-Il est affecté au groupe ” Tournage et post-production ” un nombre maximal de 20 points répartis entre les trois sous-groupes suivants :
1° Sous-groupe ” Lieux de tournage ” :
a) Il est affecté au sous-groupe ” Lieux de tournage ” un nombre de 5 points ;
b) Les points sont obtenus si le tournage est effectué en France. Si une partie du tournage est effectuée à l’étranger et n’est pas justifiée par des raisons artistiques tenant au scénario, les points ne sont pas obtenus ;
2° Sous-groupe ” Matériels techniques de tournage ” :
a) Il est affecté au sous-groupe ” Matériels techniques de tournage ” un nombre maximal de 4,5 points repartis entre les postes suivants :

-prises de vues : 2 points ;
-éclairage : 1,5 point ;
-machinerie et autres matériels : 1 point ;

b) Les points sont obtenus si au moins 50 % des dépenses se rapportant à chaque poste concerné correspondent à des prestations effectuées par des entreprises établies en France ;
3° Sous-groupe ” Post-production ” :
a) Il est affecté au sous-groupe ” Post-production ” un nombre maximal de 10,5 points répartis entre les postes suivants :

-image : 3,5 points. Ces points concernent tous les travaux de post-production image, à l’exception des effets visuels numériques ;
-son : 3,5 points. Ces points concernent tous les travaux de post-production sonore ;
-effets visuels numériques : 3,5 points. Lorsqu’il n’est pas fait appel à ce poste pour des raisons artistiques ou techniques justifiées, les points sont obtenus dès lors que les points correspondants au poste ” Image ” et au poste ” Son ” sont obtenus ;

b) Les points sont obtenus si au moins 50 % des dépenses se rapportant à chaque poste concerné correspondent à des prestations effectuées par des entreprises établies en France.
B.-Tout point relevant d’un poste autre que le poste ” Effets visuels numériques ” auquel il n’est pas fait appel pour des raisons artistiques ou techniques justifiées est réputé obtenu pour les œuvres cinématographiques d’initiative française.
