Article 220-3 of the French Civil Code

Are voidable, at the request of the requesting spouse, all acts performed in violation of the ordinance, if they were performed with a third party in bad faith, or even in the case of property the alienation of which is subject to publicity, if they are merely subsequent to the publication provided for in the preceding article.

The action for nullity is open to the requesting spouse for two years from the day on which he or she became aware of the deed, without ever being able to be brought, if the deed is subject to publicity, more than two years after its publication.

Article 220-3

Sont annulables, à la demande du conjoint requérant, tous les actes accomplis en violation de l’ordonnance, s’ils ont été passés avec un tiers de mauvaise foi, ou même s’agissant d’un bien dont l’aliénation est sujette à publicité, s’ils sont simplement postérieurs à la publication prévue par l’article précédent.

L’action en nullité est ouverte à l’époux requérant pendant deux années à partir du jour où il a eu connaissance de l’acte, sans pouvoir jamais être intentée, si cet acte est sujet à publicité, plus de deux ans après sa publication.
