Article 2299 of the French Civil Code

The professional creditor is required to warn the natural person guarantor when the principal debtor’s commitment is unsuited to the latter’s financial capacities.

Failing this, the creditor forfeits his right against the guarantor to the extent of the loss suffered by the latter.

Le créancier professionnel est tenu de mettre en garde la caution personne physique lorsque l’engagement du débiteur principal est inadapté aux capacités financières de ce dernier.


A défaut, le créancier est déchu de son droit contre la caution à hauteur du préjudice subi par celle-ci.
