Article 233 of the French Civil Code

Divorce may be applied for jointly by the spouses where they accept the principle of the breakdown of the marriage regardless of the facts giving rise to it.

It may be requested by one or other of the spouses or by both when each of them, assisted by a lawyer, has accepted the principle of the breakdown of the marriage by private deed countersigned by lawyers, which may be concluded before the commencement of proceedings.

Le divorce peut être demandé conjointement par les époux lorsqu’ils acceptent le principe de la rupture du mariage sans considération des faits à l’origine de celle-ci.


Il peut être demandé par l’un ou l’autre des époux ou par les deux lorsque chacun d’eux, assisté d’un avocat, a accepté le principe de la rupture du mariage par acte sous signature privée contresigné par avocats, qui peut être conclu avant l’introduction de l’instance.


Le principe de la rupture du mariage peut aussi être accepté par les époux à tout moment de la procédure.


L’acceptation n’est pas susceptible de rétractation, même par la voie de l’appel.
