Article 2364 of the French Civil Code

Sums paid in respect of the pledged claim are deducted from the secured claim when it is due.

If this is not the case, the pledged creditor retains them as security in a specially allocated account opened for this purpose with an institution authorised to receive them, with the responsibility for returning them if the secured obligation is performed. In the event of default by the debtor of the secured debt and eight days after formal notice has remained without effect, the creditor shall allocate the funds to the repayment of his debt up to the limit of the unpaid sums.

Les sommes payées au titre de la créance nantie s’imputent sur la créance garantie lorsqu’elle est échue.

Dans le cas contraire, le créancier nanti les conserve à titre de garantie sur un compte spécialement affecté ouvert à cet effet auprès d’un établissement habilité à les recevoir à charge pour lui de les restituer si l’obligation garantie est exécutée. En cas de défaillance du débiteur de la créance garantie et huit jours après une mise en demeure restée sans effet, le créancier affecte les fonds au remboursement de sa créance dans la limite des sommes impayées.
