Article 2394 of the French Civil Code

When the spouses have stipulated participation in acquests, each has, unless otherwise agreed, the option of registering the legal mortgage as security for the participation claim.

The registration may be made before the dissolution of the matrimonial regime, but it will only have effect from that dissolution and on condition that the immovables to which it relates exist on that date in the assets of the debtor spouse.

In the event of early liquidation, the registration prior to the request shall have effect from the day of the request, the subsequent registration having effect only from its date as stated in Article 2418.

The registration may also be made in the year following the dissolution of the matrimonial property regime; it will then take effect from its date.

Quand les époux ont stipulé la participation aux acquêts, chacun a, sauf convention contraire, la faculté d’inscrire l’hypothèque légale pour la sûreté de la créance de participation.

L’inscription pourra être prise avant la dissolution du régime matrimonial, mais elle n’aura d’effet qu’à compter de cette dissolution et à condition que les immeubles sur lesquels elle porte existent à cette date dans le patrimoine de l’époux débiteur.

En cas de liquidation anticipée, l’inscription antérieure à la demande a effet du jour de celle-ci, l’inscription postérieure n’ayant effet que de sa date ainsi qu’il est dit à l’article 2418.

L’inscription pourra également être prise dans l’année qui suivra la dissolution du régime matrimonial ; elle aura alors effet de sa date.
