Article 2471 of the French Civil Code

If the third-party purchaser has acquired by the same deed, for a total price or separate prices, immovables and movables, or several immovables, only some of which are mortgaged, and which may or may not form the same holding, the price of each immovable subject to registration shall be declared in the notification provided for by article 2464, by breakdown, if applicable, of the total price.

The overbidding creditor may not, in any case, be forced to extend his bid to movables or to immovables other than those mortgaged to his claim; except for the recourse of the third-party purchaser against his authors, for compensation for the damage he would suffer, either from the division of the objects of his acquisition, or from that of the holdings.

Article 2471

Dans le cas où le tiers acquéreur aurait acquis par le même acte, pour un prix global ou à des prix distincts, des immeubles et des meubles, ou plusieurs immeubles, dont certains seuls sont hypothéqués, et qui forment ou non une même exploitation, le prix de chaque immeuble frappé d’inscription sera déclaré dans la notification prévue par l’article 2464, par ventilation, s’il y a lieu, du prix global.


Le créancier surenchérisseur ne peut, en aucun cas, être contraint d’étendre sa soumission au mobilier ou à d’autres immeubles que ceux qui sont hypothéqués à sa créance ; sauf le recours du tiers acquéreur contre ses auteurs, pour l’indemnité du dommage qu’il éprouverait, soit de la division des objets de son acquisition, soit de celle des exploitations.
