Article 268 of the French Civil Code

During the proceedings, the spouses may submit to the judge for approval agreements settling all or part of the consequences of the divorce.

The judge, after checking that the interests of each of the spouses and of the children are preserved, approves the agreements by pronouncing the divorce.

Les époux peuvent, pendant l’instance, soumettre à l’homologation du juge des conventions réglant tout ou partie des conséquences du divorce.

Le juge, après avoir vérifié que les intérêts de chacun des époux et des enfants sont préservés, homologue les conventions en prononçant le divorce.
