Article 272 of the French Code of civil procedure

The decision ordering the expert appraisal may be appealed independently of the judgment on the merits with the authorisation of the first president of the court of appeal if there is a serious and legitimate reason.

The party wishing to appeal shall refer the matter to the first president who shall rule in accordance with the accelerated procedure on the merits. The writ of summons must be delivered within one month of the decision.

If he grants the application, the first president shall fix the day on which the case is to be heard by the court, which shall be seised and rule as in matters of procedure on a fixed date or as stated in article 948 as the case may be.

If the judgment ordering the expert report has also ruled on jurisdiction, the appeal shall be lodged, heard and decided in accordance with the procedures set out in articles 83 to 89.

La décision ordonnant l’expertise peut être frappée d’appel indépendamment du jugement sur le fond sur autorisation du premier président de la cour d’appel s’il est justifié d’un motif grave et légitime.

La partie qui veut faire appel saisit le premier président qui statue selon la procédure accélérée au fond. L’assignation doit être délivrée dans le mois de la décision.

S’il fait droit à la demande, le premier président fixe le jour où l’affaire sera examinée par la cour, laquelle est saisie et statue comme en matière de procédure à jour fixe ou comme il est dit à l’article 948 selon le cas.

Si le jugement ordonnant l’expertise s’est également prononcé sur la compétence, l’appel est formé, instruit et jugé selon les modalités prévues aux articles 83 à 89.
