Article 274 of the French Civil Code

The judge shall decide the manner in which the capital compensatory allowance is to be enforced from among the following forms:

1° Payment of a sum of money, whereby the granting of the divorce may be made subject to the provision of the guarantees provided for in Article 277 ;

2° Attribution of property in ownership or of a temporary or lifetime right of use, dwelling or usufruct, the judgment effecting a compulsory assignment in favour of the creditor. However, the agreement of the debtor spouse is required for the attribution in ownership of property that he or she has received by succession or gift.

Le juge décide des modalités selon lesquelles s’exécutera la prestation compensatoire en capital parmi les formes suivantes :

1° Versement d’une somme d’argent, le prononcé du divorce pouvant être subordonné à la constitution des garanties prévues à l’article 277 ;

2° Attribution de biens en propriété ou d’un droit temporaire ou viager d’usage, d’habitation ou d’usufruit, le jugement opérant cession forcée en faveur du créancier. Toutefois, l’accord de l’époux débiteur est exigé pour l’attribution en propriété de biens qu’il a reçus par succession ou donation.
