Article 284 of the French Code of civil procedure

After the time limit given to the parties by Article 282 to submit their observations, the judge sets the expert’s remuneration in the light, in particular, of the diligence carried out, compliance with the time limits set and the quality of the work provided.

The judge authorises the expert to recover the sums deposited with the court registry up to the amount due. It orders, as the case may be, either the payment of the additional sums due to the expert, indicating the party or parties responsible for them, or the return of the sums deposited in excess.

When the judge considers setting the expert’s remuneration at an amount lower than the amount requested, he must first invite the expert to make his observations.

The judge shall issue the expert with a writ of execution.

Article 284

Passé le délai imparti aux parties par l’article 282 pour présenter leurs observations, le juge fixe la rémunération de l’expert en fonction notamment des diligences accomplies, du respect des délais impartis et de la qualité du travail fourni.

Il autorise l’expert à se faire remettre jusqu’à due concurrence les sommes consignées au greffe. Il ordonne, selon le cas, soit le versement des sommes complémentaires dues à l’expert en indiquant la ou les parties qui en ont la charge, soit la restitution des sommes consignées en excédent.

Lorsque le juge envisage de fixer la rémunération de l’expert à un montant inférieur au montant demandé, il doit au préalable inviter l’expert à formuler ses observations.

Le juge délivre à l’expert un titre exécutoire.
