If the premises used as the family home belong to one of the spouses personally or in his or her own right, the judge may grant the lease to the spouse who exercises parental authority alone or jointly over one or more of their children where the children habitually reside in the home and it is in their best interests to do so.
The judge sets the term of the lease and may renew it until the youngest of the children reaches the age of majority.
The judge may terminate the lease if new circumstances justify it.
