Article 288 of the French Code of civil procedure

It is for the judge to carry out the handwriting verification in the light of the elements available to him after having, if necessary, enjoined the parties to produce any documents to be compared with him and had samples of handwriting composed under his dictation.

In determining the documents for comparison, the judge may retain any useful documents originating from one of the parties, whether or not they were issued on the occasion of the disputed deed.

Article 288

Il appartient au juge de procéder à la vérification d’écriture au vu des éléments dont il dispose après avoir, s’il y a lieu, enjoint aux parties de produire tous documents à lui comparer et fait composer, sous sa dictée, des échantillons d’écriture.

Dans la détermination des pièces de comparaison, le juge peut retenir tous documents utiles provenant de l’une des parties, qu’ils aient été émis ou non à l’occasion de l’acte litigieux.
