Article 301 of the French Civil Code

In the event of the death of one of the legally separated spouses, the other spouse retains the rights granted by law to the surviving spouse. In the event of legal separation by mutual consent, the spouses may include in their agreement a waiver of the inheritance rights conferred on them by the articles 756 to 757-3 and 764 à 766.

En cas de décès de l’un des époux séparés de corps, l’autre époux conserve les droits que la loi accorde au conjoint survivant. En cas de séparation de corps par consentement mutuel, les époux peuvent inclure dans leur convention une renonciation aux droits successoraux qui leur sont conférés par les articles 756 à 757-3 et 764 à 766.
