Article 311-68 of the French Cinema and Moving Image Code

For the production of a given work, the advance is allocated and its amount fixed after evaluation of the financial situation of the production company, taking into account the investment allocations it has received during the current year and the reasonable management of its automatic audiovisual production account. Account is also taken of the situation of the automatic audiovisual production account of the companies controlling the production company, those controlled by the latter or those controlled by one or more natural or legal persons controlling this production company.

Pour la production d’une œuvre déterminée, l’avance est attribuée et son montant fixé après évaluation de la situation financière de l’entreprise de production en tenant compte des allocations d’investissement dont elle a bénéficié durant l’année en cours et de la gestion raisonnable de son compte automatique production audiovisuelle. Il est également tenu compte de la situation du compte automatique production audiovisuelle des entreprises contrôlant l’entreprise de production, de celles contrôlées par cette dernière ou de celles contrôlées par une ou plusieurs personnes physiques ou morales contrôlant cette entreprise de production.
