Article 319 of the French Code of civil procedure

The judgment ordering the oath sets the day, time and place where it will be received. It formulates the question submitted to the oath and indicates that false oath exposes its author to penal sanctions.

When the oath is referred by a party, the judgment further specifies that the party to whom the oath is referred will succumb in his claim if he refuses to take it and refrains from referring it.

In all cases, the judgment shall be notified to the party to whom the oath is referred and, if applicable, to his representative.

Article 319

Le jugement qui ordonne le serment fixe les jour, heure et lieu où celui-ci sera reçu. Il formule la question soumise au serment et indique que le faux serment expose son auteur à des sanctions pénales.

Lorsque le serment est déféré par une partie, le jugement précise en outre que la partie à laquelle le serment est déféré succombera dans sa prétention si elle refuse de le prêter et s’abstient de le référer.

Dans tous les cas, le jugement est notifié à la partie à laquelle le serment est déféré ainsi que, s’il y a lieu, à son mandataire.
