Article 330 of the French Code of Criminal Procedure

The public prosecutor and the parties may object to the examination of a witness whose name has not been served on them or who has been irregularly served on them.

The court shall rule on such objection.

If it is found to be well founded, such witnesses may be heard, as information, under the discretionary power of the president.

Le ministère public et les parties peuvent s’opposer à l’audition d’un témoin dont le nom ne leur aurait pas été signifié ou qui leur aurait été irrégulièrement signifié.

La cour statue sur cette opposition.

Si elle est reconnue fondée, ces témoins peuvent être entendus, à titre de renseignements, en vertu du pouvoir discrétionnaire du président.
