The following depositions may not be received under oath:
1° Of the father, mother or any other ascendant of the accused, or of one of the accused present and subject to the same debate;
2° Of the son, daughter, or any other descendant;
3° Of brothers and sisters ;
4° Of relatives of the same degree;
5° Of the husband or wife, partner bound to the accused by a civil solidarity pact or cohabitee, within the meaning of Article 515-8 of the Civil Code, where this status has been alleged by the witness, the accused or a party and is not contested or is established by the elements of the proceedings; this prohibition continues even after divorce, the dissolution of a civil solidarity pact or the cessation of cohabitation;
6° Of the civil party;
7° Of children under the age of sixteen;
8° Of any person who has been accused, charged or convicted either for the crime before the assize court as co-perpetrator or accomplice, or for a crime or misdemeanour related to or forming an indivisible whole with the crime before the assize court.
