Article 336 of the French Code of Criminal Procedure

Nevertheless, the hearing under oath of the persons designated by the preceding article shall not entail nullity where neither the public prosecutor nor any of the parties has objected to the taking of the oath.

In the event of opposition by the public prosecutor or one or more of the parties, the witness may be heard as information, by virtue of the discretionary power of the president.

Néanmoins, l’audition sous serment des personnes désignées par l’article précédent n’entraîne pas nullité lorsque le ministère public ni aucune des parties ne s’est opposé à la prestation de serment.

En cas d’opposition du ministère public ou d’une ou plusieurs des parties, le témoin peut être entendu à titre de renseignements, en vertu du pouvoir discrétionnaire du président.
