Article 342 of the French Code of Criminal Procedure

If, after the proceedings, the evidence of a witness appears to be false, the president, either of his own motion or at the request of the public prosecutor or one of the parties, may specially order that witness to be present at the proceedings until they are closed and, in addition, to remain in the courtroom until the judgment of the assize court has been delivered. In the event of a breach of this order, the president shall have the witness placed under provisional arrest.

After the judgment of the assize court has been read, or, in the event of referral to another session, the president shall order that the witness be, by the force publique, taken without delay before the public prosecutor who shall request that an investigation be opened.

The court clerk shall send this magistrate a copy of the report that may have been drawn up pursuant to Article 333.

Article 342

Si, d’après les débats, la déposition d’un témoin paraît fausse, le président, soit d’office, soit à la requête du ministère public ou d’une des parties peut ordonner spécialement à ce témoin d’être présent aux débats jusqu’à leur clôture et en outre de demeurer dans la salle d’audience jusqu’au prononcé de l’arrêt de la cour d’assises. En cas d’infraction à cet ordre, le président fait mettre le témoin en état d’arrestation provisoire.

Après lecture de l’arrêt de la cour d’assises, ou, dans le cas de renvoi à une autre session, le président ordonne que le témoin soit, par la force publique, conduit sans délai devant le procureur de la République qui requiert l’ouverture d’une information.

Le greffier transmet à ce magistrat une expédition du procès-verbal qui a pu être dressé par application de l’article 333.
