The application for recusal or dismissal on grounds of legitimate suspicion shall be made to the first president of the court of appeal. It shall be made by a deed delivered to the registry of the court of appeal.
Where the cause justifying the request is discovered at the hearing, the request shall be made by a statement recorded by the registrar in an official report, which shall be sent without delay to the first president. A copy shall be kept in the file.
The request must, on pain of inadmissibility, state the grounds for the challenge or dismissal on grounds of legitimate suspicion and be accompanied by supporting documents.
A receipt shall be issued for the request.
