Article 344 of the French Code of civil procedure

The application for recusal or dismissal on grounds of legitimate suspicion shall be made to the first president of the court of appeal. It shall be made by a deed delivered to the registry of the court of appeal.

Where the cause justifying the request is discovered at the hearing, the request shall be made by a statement recorded by the registrar in an official report, which shall be sent without delay to the first president. A copy shall be kept in the file.

The request must, on pain of inadmissibility, state the grounds for the challenge or dismissal on grounds of legitimate suspicion and be accompanied by supporting documents.

A receipt shall be issued for the request.

Article 344

La demande de récusation ou de renvoi pour cause de suspicion légitime est portée devant le premier président de la cour d’appel. Elle est formée par acte remis au greffe de la cour d’appel.

Lorsque la cause justifiant la demande est découverte à l’audience, la demande est formée par déclaration consignée par le greffier dans un procès-verbal, qui est adressé sans délai au premier président. Une copie en est conservée au dossier.

La demande doit, à peine d’irrecevabilité, indiquer les motifs de récusation ou de renvoi pour cause de suspicion légitime et être accompagnée des pièces justificatives.

Il est délivré récépissé de la demande.
