Article 346 of the French Code of civil procedure

The First President shall rule without debate within one month of the matter being referred to him, after obtaining the opinion of the Public Prosecutor. Where the application for recusal concerns the juge des libertés et de la détention ruling in the disputes referred to in article L. 213-8 of the code de l’organisation judiciaire, the first president shall rule promptly.

The clerk of the court shall, by any means and without delay, notify the parties, the judge whose disqualification has been requested and the president of the court to which this judge belongs or whose removal has been requested of the decision made.

An appeal may be lodged against the order rejecting the request for disqualification or dismissal on grounds of legitimate suspicion within fifteen days of its notification by the clerk of the court.

Article 346

Le premier président statue sans débat dans le délai d’un mois à compter de sa saisine après avis du procureur général. Lorsque la demande de récusation concerne le juge des libertés et de la détention statuant dans les contentieux visés à l’article L. 213-8 du code de l’organisation judiciaire, le premier président statue à bref délai.

Le greffier avise, par tout moyen et sans délai, de la décision rendue les parties, le juge dont la récusation a été demandée et le président de la juridiction à laquelle appartient ce magistrat ou dont le dessaisissement a été demandé.

L’ordonnance rejetant la demande de récusation ou de renvoi pour cause de suspicion légitime peut faire l’objet d’un pourvoi dans les quinze jours de sa notification par le greffe.
