Article 348-2 of the French Civil Code

When the child’s parents are deceased, unable to express their wishes or have lost their rights of parental authority, consent is given by the family council, after consulting the person who, in fact, cares for the child. The same applies if the child’s filiation has not been established.

Lorsque les parents de l’enfant sont décédés, dans l’impossibilité de manifester leur volonté ou s’ils ont perdu leurs droits d’autorité parentale, le consentement est donné par le conseil de famille, après avis de la personne qui, en fait, prend soin de l’enfant. Il en est de même lorsque la filiation de l’enfant n’est pas établie.
