Article 348 of the French Civil Code

When the filiation of a minor is established with regard to both parents, both must consent to the adoption.

If one of them is deceased, unable to express his or her will, or has lost his or her rights of parental authority, the consent of the other is sufficient.

Lorsque la filiation d’un mineur est établie à l’égard de ses deux parents, l’un et l’autre doivent consentir à l’adoption.


Si l’un d’eux est décédé, dans l’impossibilité de manifester sa volonté, ou s’il a perdu ses droits d’autorité parentale, le consentement de l’autre suffit.
