Article 349-1 of the French Code of Criminal Procedure

Where the existence of one of the grounds of lack of criminal responsibility provided for by the articles 122-1 (first paragraph), 122-2, 122-3, 122-4 (first and second paragraphs), 122-5 (first and second paragraphs) and 122-7 of the Criminal Code, each fact specified in the operative part of the committal decision is the subject of two questions put as follows:

“1° Has the accused committed such and such an act?”;

“2° Does the accused benefit, in respect of this act, from the ground of lack of criminal responsibility provided for by Article… of the Criminal Code, according to which a person who… is not criminally responsible is not criminally responsible? ? “

The president may, with the agreement of the parties, ask only one question concerning the cause of irresponsibility for all the acts of which the accused is accused.

Unless the accused or his defence counsel waives this right, the questions asked pursuant to this article shall be read out.

Article 349-1

Lorsque est invoquée comme moyen de défense l’existence de l’une des causes d’irresponsabilité pénale prévues par les articles 122-1 (premier alinéa), 122-2, 122-3, 122-4 (premier et second alinéas), 122-5 (premier et second alinéas) et 122-7 du code pénal, chaque fait spécifié dans le dispositif de la décision de mise en accusation fait l’objet de deux questions posées ainsi qu’il suit :

” 1° L’accusé a-t-il commis tel fait ? ;

” 2° L’accusé bénéficie-t-il pour ce fait de la cause d’irresponsabilité pénale prévue par l’article… du code pénal selon lequel n’est pas pénalement responsable la personne qui… ? ”

Le président peut, avec l’accord des parties, ne poser qu’une seule question concernant la cause d’irresponsabilité pour l’ensemble des faits reprochés à l’accusé.

Sauf si l’accusé ou son défenseur y renonce, il est donné lecture des questions posées en application du présent article.
