Article 351 of the French Code of Criminal Procedure

If it emerges from the proceedings that the offence has a legal classification other than that given by the decision to bring the indictment, the President shall put one or more subsidiary questions.
Where the accused of full age is indicted on the charge of rape aggravated by the victim’s minority of fifteen years, the president shall ask the subsidiary question of the qualification of sexual assault on the person of a minor of fifteen years if the existence of violence or coercion, threat or surprise was disputed during the proceedings.

S’il résulte des débats que le fait comporte une qualification légale autre que celle donnée par la décision de mise en accusation, le président pose une ou plusieurs questions subsidiaires.


Lorsque l’accusé majeur est mis en accusation du chef de viol aggravé par la minorité de quinze ans de la victime, le président pose la question subsidiaire de la qualification d’atteinte sexuelle sur la personne d’un mineur de quinze ans si l’existence de violences ou d’une contrainte, menace ou surprise a été contestée au cours des débats.
