Article 358 of the French Civil Code

With the exception of its last paragraph, Article 357 is applicable to a child who has been the subject of an adoption duly pronounced abroad having in France the effects of a full adoption.

The adopters shall exercise the option available to them under this article when applying for transcription of the adoption judgment, by a declaration addressed to the public prosecutor of the place where such transcription is to be made.

When the adopters apply for the exequatur of the foreign adoption judgment, they shall attach the declaration of option to their application. Mention of this declaration is made in the decision.

The chosen name is mentioned, at the request of the public prosecutor, in the child’s birth certificate.

A l’exception de son dernier alinéa, l’article 357 est applicable à l’enfant qui a fait l’objet d’une adoption régulièrement prononcée à l’étranger ayant en France les effets de l’adoption plénière.

Les adoptants exercent l’option qui leur est ouverte par cet article lors de la demande de transcription du jugement d’adoption, par déclaration adressée au procureur de la République du lieu où cette transcription doit être opérée.

Lorsque les adoptants sollicitent l’exequatur du jugement d’adoption étranger, ils joignent la déclaration d’option à leur demande. Mention de cette déclaration est portée dans la décision.

La mention du nom choisi est opérée à la diligence du procureur de la République, dans l’acte de naissance de l’enfant.
