Article 38 of the French Code of civil procedure

Where an incidental claim exceeds the rate of its jurisdiction, the judge, if a party raises lack of jurisdiction, may either rule only on the original claim or refer the parties to litigate the whole before the court having jurisdiction to hear the incidental claim. However, where a counterclaim for damages is based exclusively on the original claim, the court shall hear the counterclaim regardless of the amount of the damages.

Lorsqu’une demande incidente est supérieure au taux de sa compétence, le juge, si une partie soulève l’incompétence, peut soit ne statuer que sur la demande initiale, soit renvoyer les parties à se pourvoir pour le tout devant la juridiction compétente pour connaître de la demande incidente. Toutefois, lorsqu’une demande reconventionnelle en dommages-intérêts est fondée exclusivement sur la demande initiale, le juge en connaît à quelque somme qu’elle s’élève.
