Article 380-12 of the French Code of Criminal Procedure

The statement of appeal must be made at the registry of the assize court which handed down the contested decision.

It must be signed by the registrar and by the appellant himself, by a lawyer, or by a special proxy; in the latter case, the proxy is appended to the document drawn up by the registrar. If the appellant is unable to sign, this will be noted by the registrar.

It will be entered in a public register for this purpose and any person has the right to have a copy issued.

Where the appeal is lodged by the public prosecutor and the seat of the assize court is not that of the court of appeal, the statement of appeal, signed by the public prosecutor, shall be sent without delay, in original or copy, to the registry of the assize court; it shall be transcribed in the register provided for in the preceding paragraph and appended to the document drawn up by the registrar.

La déclaration d’appel doit être faite au greffe de la cour d’assises qui a rendu la décision attaquée.

Elle doit être signée par le greffier et par l’appelant lui-même, par un avocat, ou par un fondé de pouvoir spécial ; dans ce dernier cas, le pouvoir est annexé à l’acte dressé par le greffier. Si l’appelant ne peut signer, il en sera fait mention par le greffier.

Elle est inscrite sur un registre public à ce destiné et toute personne a le droit de s’en faire délivrer une copie.

Lorsque l’appel est formé par le procureur général et que le siège de la cour d’assises n’est pas celui de la cour d’appel, la déclaration d’appel, signée par le procureur général, est adressée sans délai, en original ou en copie, au greffe de la cour d’assises ; elle est transcrite sur le registre prévu à l’alinéa précédent et annexée à l’acte dressé par le greffier.
