Where the assize court ruling at first instance on the civil action has ordered the provisional payment, in whole or in part, of the damages awarded, such provisional enforcement may be halted, on appeal, by the first president, ruling in summary proceedings if it is likely to entail manifestly excessive consequences. The first president may make the suspension of provisional enforcement subject to the provision of a guarantee, real or personal, sufficient to meet any restitution or reparation.
Where provisional enforcement has been refused by the court ruling on the civil action or where provisional enforcement has not been requested, or if, having been requested, the court has failed to rule, it may be granted, in the event of an appeal, by the first president ruling in summary proceedings.
For the application of the provisions of this article, the first president of the court of appeal within whose jurisdiction the assize court designated to hear the case on appeal sits shall have jurisdiction.
