Article 389 of the French Code of Criminal Procedure

The warning, issued by the public prosecutor, dispenses with the summons, if it is followed by the voluntary appearance of the person to whom it is addressed.

It indicates the offence being prosecuted and refers to the text of the law which punishes it.

Where the accused is detained, the judgment must record the consent of the person concerned to be tried without prior summons.

L’avertissement, délivré par le ministère public, dispense de citation, s’il est suivi de la comparution volontaire de la personne à laquelle il est adressé.

Il indique le délit poursuivi et vise le texte de loi qui le réprime.

Lorsqu’il s’agit d’un prévenu détenu, le jugement doit constater le consentement de l’intéressé à être jugé sans citation préalable.
