Article 39 B of the French General Tax Code

At the close of each financial year, the sum of depreciation actually applied since the acquisition or creation of a given item may not be less than the cumulative amount of depreciation calculated using the straight-line method and spread over the normal period of use. If the company fails to comply with this requirement, it permanently loses the right to deduct the portion of depreciation that has been deferred in this way.

A la clôture de chaque exercice, la somme des amortissements effectivement pratiqués depuis l’acquisition ou la création d’un élément donné ne peut être inférieure au montant cumulé des amortissements calculés suivant le mode linéaire et répartis sur la durée normale d’utilisation. A défaut de se conformer à cette obligation, l’entreprise perd définitivement le droit de déduire la fraction des amortissements qui a été ainsi différée.
