Article 40-4 of the French Code of Criminal Procedure

When the victim wishes to act as a civil party and requests the appointment of a lawyer after having been informed of this right pursuant to 3° of Article 10-2, the public prosecutor, notified by the officer or agent of the judicial police, if he or she decides to initiate public proceedings, shall immediately inform the President of the Bar Association.

If he decides not to do so, he will inform the victim, by notifying him that his complaint has been closed, that he may apply directly to the President of the Bar if he maintains his intention to obtain compensation for his loss.

Lorsque la victime souhaite se constituer partie civile et demande la désignation d’un avocat après avoir été informée de ce droit en application du 3° de l’article 10-2, le procureur de la République, avisé par l’officier ou l’agent de police judiciaire, s’il décide de mettre l’action publique en mouvement, en informe sans délai le bâtonnier de l’ordre des avocats.

Dans le cas contraire, il indique à la victime, en l’avisant du classement de sa plainte, qu’elle peut directement adresser sa demande de désignation auprès du bâtonnier si elle maintient son intention d’obtenir la réparation de son préjudice.
