Article 407 of the French Code of Criminal Procedure

In the event that the accused, the civil party or the witness does not sufficiently speak the French language, or if it is necessary to translate a document submitted to the debates, the president shall appoint an interpreter ex officio, who must be at least twenty-one years of age, and shall make him/her take an oath to assist justice in his/her honour and conscience.

The public prosecutor, the accused and the civil party may challenge the interpreter, stating the reasons for their challenge. The court shall rule on this challenge, and its decision shall not be subject to appeal.

The interpreter may not, even with the consent of the accused or the public prosecutor, be taken from among the judges composing the court, the clerk holding the hearing, the parties and the witnesses.

Article 407

Dans le cas où le prévenu, la partie civile ou le témoin ne parle pas suffisamment la langue française, ou s’il est nécessaire de traduire un document versé aux débats, le président désigne d’office un interprète, âgé de vingt et un ans au moins, et lui fait prêter serment d’apporter son concours à la justice en son honneur et en sa conscience.

Le ministère public, le prévenu et la partie civile peuvent récuser l’interprète en motivant leur récusation. Le tribunal se prononce sur cette récusation, et sa décision n’est susceptible d’aucune voie de recours.

L’interprète ne peut, même du consentement du prévenu ou du ministère public, être pris parmi les juges composant le tribunal, le greffier qui tient l’audience, les parties et les témoins.
