Article 431 of the French Civil Code

The application must be accompanied, on pain of inadmissibility, by a detailed certificate drawn up by a doctor chosen from a list drawn up by the public prosecutor. This doctor may seek the opinion of the doctor treating the person who should be protected.

The cost of this certificate is set by decree in the Conseil d’Etat.

When a matter is referred to the public prosecutor by a person other than one of the relatives of the person of full age listed in the first paragraph of article 430, the request sent to the guardianship judge must also include, on pain of inadmissibility, the information available to that person on the social and financial situation of the person who should be protected and an assessment of his autonomy as well as, where applicable, an assessment of the personalised actions carried out with him. The nature and procedures for gathering information are defined by regulation. The public prosecutor may request additional information from the third party who referred the matter to him or her.

Article 431

La demande est accompagnée, à peine d’irrecevabilité, d’un certificat circonstancié rédigé par un médecin choisi sur une liste établie par le procureur de la République. Ce médecin peut solliciter l’avis du médecin traitant de la personne qu’il y a lieu de protéger.

Le coût de ce certificat est fixé par décret en Conseil d’Etat.

Lorsque le procureur de la République est saisi par une personne autre que l’une de celles de l’entourage du majeur énumérées au premier alinéa de l’article 430, la requête transmise au juge des tutelles comporte en outre, à peine d’irrecevabilité, les informations dont cette personne dispose sur la situation sociale et pécuniaire de la personne qu’il y a lieu de protéger et l’évaluation de son autonomie ainsi que, le cas échéant, un bilan des actions personnalisées menées auprès d’elle. La nature et les modalités de recueil des informations sont définies par voie réglementaire. Le procureur de la République peut solliciter du tiers qui l’a saisi des informations complémentaires.
