Article 431 of the French Code of civil procedure

The public prosecutor is only required to attend the hearing in cases where he is the principal party, in cases where he represents another party or where his presence is made compulsory by law.

In all other cases, he may make his opinion known to the court either by sending written submissions which are made available to the parties, or orally at the hearing.

Le ministère public n’est tenu d’assister à l’audience que dans les cas où il est partie principale, dans ceux où il représente autrui ou lorsque sa présence est rendue obligatoire par la loi.

Dans tous les autres cas, il peut faire connaître son avis à la juridiction soit en lui adressant des conclusions écrites qui sont mises à la disposition des parties, soit oralement à l’audience.
