Article 437 of the French Code of civil procedure

If it appears or if it is claimed either that the debates should take place in chambers when they are taking place in open court, or the reverse, the president will rule immediately and the incident will be disregarded.

If the hearing is continued in its regular form, no nullity based on its previous conduct may subsequently be pronounced, even of his own motion.

S’il apparaît ou s’il est prétendu soit que les débats doivent avoir lieu en chambre du conseil alors qu’ils se déroulent en audience publique, soit l’inverse, le président se prononce sur-le-champ et il est passé outre à l’incident.

Si l’audience est poursuivie sous sa forme régulière, aucune nullité fondée sur son déroulement antérieur ne pourra être ultérieurement prononcée, même d’office.
