On pain of lapsing, the safeguard of justice measure may not exceed one year, renewable once under the conditions set out in the fourth paragraph of Article 442.
When the safeguard of justice has been pronounced pursuant to Article 433, the judge may, at any time, order its release if the need for temporary protection ceases.
When the safeguard of justice has been opened pursuant to Article 434, it may be terminated by a declaration made to the public prosecutor if the need for temporary protection ceases or by striking out the medical declaration by decision of the public prosecutor.
In all cases, in the absence of a release, declaration of cessation or striking off of the medical declaration, the safeguard of justice ends on expiry of the period or after completion of the acts for which it was ordered. It is also terminated by the opening of a curatorship or guardianship measure from the day on which the new legal protection measure takes effect.
