Article 444 of the French Code of Criminal Procedure

The witnesses then testify separately, either as to the facts with which the accused is charged, or as to his character and morality.

Of the witnesses called, those produced by the prosecuting parties shall be heard first, save for the president himself to settle sovereignly the order in which the witnesses are to be heard.

Persons proposed by the parties who are present at the opening of the proceedings without having been duly summoned may also, with the permission of the court, be admitted to give evidence.

Les témoins déposent ensuite séparément, soit sur les faits reprochés au prévenu, soit sur sa personnalité et sur sa moralité.

Parmi les témoins cités, ceux qui sont produits par les parties poursuivantes sont entendus les premiers, sauf pour le président à régler lui-même souverainement l’ordre d’audition des témoins.

Peuvent également, avec l’autorisation du tribunal, être admises à témoigner, les personnes, proposées par les parties, qui sont présentes à l’ouverture des débats sans avoir été régulièrement citées.
