Article 449 of the French Civil Code

Failing an appointment made pursuant to Article 448, the judge shall appoint, as curator or guardian, the spouse of the protected person, the partner with whom he or she has entered into a civil solidarity pact or his or her cohabiting partner, unless life together has ceased between them or some other cause prevents him or her from being entrusted with the measure.

Failing an appointment made pursuant to the preceding paragraph and subject to the last proviso mentioned therein, the judge shall appoint a relative, ally or person residing with the protected adult of full age or maintaining close and stable ties with him or her.

The judge takes into consideration the feelings expressed by the latter, his or her usual relationships, the interest shown in him or her and any recommendations made by his or her parents and relatives as well as his or her entourage.

Article 449

A défaut de désignation faite en application de l’article 448, le juge nomme, comme curateur ou tuteur, le conjoint de la personne protégée, le partenaire avec qui elle a conclu un pacte civil de solidarité ou son concubin, à moins que la vie commune ait cessé entre eux ou qu’une autre cause empêche de lui confier la mesure.

A défaut de nomination faite en application de l’alinéa précédent et sous la dernière réserve qui y est mentionnée, le juge désigne un parent, un allié ou une personne résidant avec le majeur protégé ou entretenant avec lui des liens étroits et stables.

Le juge prend en considération les sentiments exprimés par celui-ci, ses relations habituelles, l’intérêt porté à son égard et les recommandations éventuelles de ses parents et alliés ainsi que de son entourage.
