Article 466 of the French Code of Criminal Procedure

If the court duly seised of an act classified as a misdemeanour by law, considers, at the end of the proceedings, that the act only constitutes a contravention, it shall impose the penalty and rule, if appropriate, on the civil action.

Si le tribunal régulièrement saisi d’un fait qualifié délit par la loi, estime, au résultat des débats, que ce fait ne constitue qu’une contravention, il prononce la peine et statue, s’il y a lieu, sur l’action civile.
