Article 469-1 of the French Code of Criminal Procedure

Notwithstanding the provisions of the first paragraph of Article 464, the court may, after finding the accused guilty, either exempt him or her from sentencing or defer sentencing under the conditions set out in Articles 132-59 to 132-70 of the Penal Code and articles 747-3 and 747-4 of this Code. It shall rule on any civil action.

The exemption from punishment excludes the application of provisions providing for prohibitions, disqualifications or incapacities of any kind whatsoever that would automatically result from a conviction.

Nonobstant les dispositions de l’alinéa premier de l’article 464, le tribunal peut, après avoir déclaré le prévenu coupable, soit le dispenser de peine, soit ajourner le prononcé de celle-ci dans les conditions prévues aux articles 132-59 à 132-70 du code pénal et aux articles 747-3 et 747-4 du présent code. Il statue s’il y a lieu sur l’action civile.

La dispense de peine exclut l’application des dispositions prévoyant des interdictions, déchéances ou incapacités de quelque nature qu’elles soient qui résulteraient de plein droit d’une condamnation.
