Article 481 of the French Code of Criminal Procedure

If the court considers that the items placed in the hands of the justice system are useful in establishing the truth or are liable to confiscation, it shall stay the proceedings until it has reached a decision on the merits.

In this case, the judgment is not subject to appeal.

The court may refuse restitution where it presents a danger to persons or property or where the property seized is the instrument or direct or indirect product of the offence.

Article 481

Si le tribunal estime que les objets placés sous la main de la justice sont utiles à la manifestation de la vérité ou susceptibles de confiscation, il surseoit à statuer jusqu’à sa décision sur le fond.

Dans ce cas, le jugement n’est susceptible d’aucun recours.

Le tribunal peut refuser la restitution lorsque celle-ci présente un danger pour les personnes ou les biens ou lorsque le bien saisi est l’instrument ou le produit direct ou indirect de l’infraction.
