Article 485-1 of the French Code of Criminal Procedure

In the event of a conviction, without prejudice to the provisions providing for special reasons to be given for certain sentences, in particular unmodified sentences of unsuspended imprisonment, the reasons must also cover the choice of sentence with regard to the provisions of articles 132-1 and 132-20 of the Penal Code, except in the case of a mandatory sentence or confiscation of the proceeds or object of the offence. The specific obligations of the probationary suspension do not have to be justified.

En cas de condamnation, sans préjudice des dispositions prévoyant la motivation spéciale de certaines peines, notamment des peines non aménagées d’emprisonnement ferme, la motivation doit également porter sur le choix de la peine au regard des dispositions des articles 132-1 et 132-20 du code pénal, sauf s’il s’agit d’une peine obligatoire ou de la confiscation du produit ou de l’objet de l’infraction. Les obligations particulières du sursis probatoire n’ont pas à être motivées.
