Article 494-2 of the French Civil Code

Family habilitation may only be ordered by the judge in cases of necessity and when the interests of the person cannot be sufficiently provided for by applying the rules of the ordinary law of representation, those relating to the respective rights and duties of spouses and the rules of matrimonial property regimes, in particular those provided for in articles 217, 219, 1426 and 1429, or by the stipulations of the future protection mandate concluded by the interested party.

L’habilitation familiale ne peut être ordonnée par le juge qu’en cas de nécessité et lorsqu’il ne peut être suffisamment pourvu aux intérêts de la personne par l’application des règles du droit commun de la représentation, de celles relatives aux droits et devoirs respectifs des époux et des règles des régimes matrimoniaux, en particulier celles prévues aux articles 217, 219, 1426 et 1429, ou par les stipulations du mandat de protection future conclu par l’intéressé.
