Article 495-24-2 of the French Code of Criminal Procedure

When the public prosecution for an offence that has caused harm to a victim is extinguished by the payment of a fixed fine for a misdemeanour, the victim may nevertheless ask the public prosecutor to summon the perpetrator to a hearing before the court to enable him or her to bring a civil action. The court, composed of a single magistrate exercising the powers conferred on the president, will then rule only on the civil interests, based on the case file that is submitted for the debate. The public prosecutor informs the victim of his or her rights and, when summoning the perpetrator to appear before the criminal court, of the date of the hearing.

Lorsque l’action publique concernant un délit ayant causé un préjudice à une victime est éteinte par le paiement d’une amende forfaitaire délictuelle, la victime peut toutefois demander au procureur de la République de citer l’auteur des faits à une audience devant le tribunal pour lui permettre de se constituer partie civile. Le tribunal, composé d’un seul magistrat exerçant les pouvoirs conférés au président, ne statue alors que sur les seuls intérêts civils, au vu du dossier de la procédure qui est versé au débat. Le procureur de la République informe la victime de ses droits ainsi que, lorsqu’il cite l’auteur des faits devant le tribunal correctionnel, de la date de l’audience.
