Article 495-24 of the French Code of Criminal Procedure

When the person who has been fined an increased fixed-rate fine does not contest the reality of the offence but, due to financial difficulties, requests payment deadlines or an exonerated fine, they send their reasoned request to the competent public accountant.

In this case, article 495-20 is not applicable.

If the competent public accountant considers the request to be justified, he or she may then grant time limits or issue a decision for partial or total remission, where applicable by applying a 20% reduction to the sums due, pursuant to article 707-4.

Lorsque la personne qui a fait l’objet d’une amende forfaitaire majorée ne conteste pas la réalité du délit mais sollicite, en raison de ses difficultés financières, des délais de paiement ou une remise gracieuse, elle adresse sa demande motivée au comptable public compétent.


Dans ce cas, l’article 495-20 n’est pas applicable.


S’il estime la demande justifiée, le comptable public compétent peut alors octroyer des délais ou rendre une décision de remise gracieuse partielle ou totale, le cas échéant en appliquant une diminution de 20 % des sommes dues, en application de l’article 707-4.
